Resumen
La propuesta de Ferrajoli de la creación de una Constitución de la Tierra ha hecho eco en muchas concepciones que se tienen hasta ahora de los ordenamientos normativos y ha proporcionado una mirada novedosa por cuanto a los límites que han de fijarse a los Estados soberanos en pro de la presente y futura existencia de la humanidad. Los procesos de globalización han llegado a los ordenamientos normativos desde el siglo pasado; sin embargo, estos procesos arrastran, en demasiadas ocasiones, fenómenos de discriminación y exclusión de grupos vulnerados. Este trabajo se propone analizar el proyecto ferrajoliano de la Constitución de la Tierra a través de una perspectiva de discapacidad que es necesaria en la consecución de protección, garantía de los derechos humanos y de alcanzar la inclusión de este grupo vulnerado. Abstract
Ferrajoli's proposal for the creation of a Earth Constitution has been an echo of many concepts that have so far been put into law and have been a new look at the boundaries to be established for sovereign states for the present and future existence of humanity. The processes of globalization have come into normative order since the last century, but these processes have been leading too often to discrimination and exclusion from damaged groups. That work aims to analyse the Ferrajolian project of the Earth Constitution through a disability perspective that is necessary to achieve protection and guarantee human rights and to achieve the inclusion of this damaged group.
