La hermenéutica analógica como método de interpretación constitucional

Resumen
La aplicación del derecho, más que una conclusión lógica, es un tema de interpretación. Sin embargo, frente a la miríada de métodos que reconoce la doctrina y la jurisprudencia en todos los sistemas jurídicos vale la pena preguntarse, ¿qué tipos de interpretación son válidos y cuáles aseguran que se alcance el fin último de la justicia? Esta enorme cuestión es el centro del presente artículo. En éste, me dispongo a presentar a la hermenéutica analógica como el método más acertado de interpretación constitucional –y jurídica– debido a que es, en sí misma, la justicia aplicada en el terreno práctico. Summary: The application of law, more than a logical conclusion, is a matter of interpretation. However, due to the myriad of methods recognized by doctrine and jurisprudence through all judicial systems, it is worth asking which types of interpretation are valid and which ones assure that justice is reached? This important issue is the objective of this article in which I propose that the analogical hermeneutic is the most accurate method of constitutional –and judicial– interpretation because it is, in itself, justice executed in the practical world.

Abstract
The application of the law, rather than a logical conclusion, was an issue of interpretation. Nevertheless, with the myriad methods that doctrine and jurisprudence recognizes in all legal systems, what forms of interpretation are valid and what are they sure that the ultimate end of justice will be achieved? That huge issue is at the heart of this article. At this stage, I propose to propose to the analytic hermeneutics as the best method of constitutional and legal interpretation, as it is, in itself, the justice applied in practice. Summary: The application of law, more than a logical conclusion, is a matter of interpretation. Nevertheless, due to the myriad of methods recognized by doctrine and jurisprudence through all judicial systems, it is worth asking which types of interpretation are valid and which ones assure that justice is reached? This important issue is the objective of this article in which I propose that the analogue hermeneutić is the most accurate method of constitutional -and judicial-interpretation because it is, in itself, justice performed in the practical world.
Keywords: Judicial interpretation, analogical hermeneutic, justice, law, además, sino a la naturaleza misma del ser humano. Sin embargo, tanto más ya se ha establecido. En este tópico, hay un significativo consenso. Sin embargo, el punto más álgido es, sin lugar a dudas, cómo se ha de ejecutar, es decir, al partir de derechos humanos –o derechos fundamentales, dependiendo el sistema del que se trate–, "interpretación jurídica", aprueba o no dice nada. En otras situaciones, como intento explicar, la proporción es analogía. Incluso, en el presente artículo, más allá del mero formalismo silogístico.
