Resumen
La Teoría de la Argumentación Jurídica nace en la década de 1970 como una nueva disciplina del razonamiento jurídico, la que se caracteriza por tratar de integrar las concepciones lógicas, retóricas y dialécticas de la argumentación filosófica en una propuesta cuyo objetivo consiste en la justificación racional de las decisiones jurídicas. Esta concepción disciplinar ha tenido un desarrollo que marca su origen en los idiomas alemán e inglés y ha experimentado un crecimiento importante en lengua española. En cambio, en los idiomas italiano y francés esta teoría ha tenido sólo un interés marginal. El tema central de la Teoría de la Argumentación Jurídica es la fundamentación racional de las afirmaciones jurídico-normativas. Abstract
The Theory of Legal Argumentation was born in the 1970s as a new discipline of legal reasoning, and this is characterized by an attempt to integrate the logical, rhetorical and dialectical concepts of philosophical argument into a proposal with a goal of rational justification of legal decisions. That disciplining vision had been developed and had been an important development in Spanish and German. Instead, in the Italian and French languages this theory has been of marginal interest only. The central issue of the Theory of Legal Argumentation is rational substantiation of legal and normative claims.
